Private Money Information

The term "Private money" is a commonly used in banking and finance to refer to money lent to a a company or individual by a private individual or organization.

For many, the ability to qualify for traditional financing (i.e. a neighborhood bank) isn't possible. Typically these are non-real estate backed, and result in higher risk to the lending organization. Although there might be less "red tape" and regulation in the process, the rate can vary according to the risk.

Private money brings an opportunity for both the lender and borrower. For the borrower, this might be the only way to get money. For the lender, they can earn above average rates of return on their money. Of course, that brings a risk (secured or unsecured) that a private money loan may not be re-paid on time or at all without legal action.

Private money lenders however, must still comply with state and federal usury laws. They are not exempt from standard banking laws. However they might be exempt from routine regulation such as banking exams etc. States and banks vary in requirements, regulations, etc.

It is important to always get careful advice and oversight of an accountant or other professional prior to borrowing any money from any individual or institution.
